6. Description of the contract
Construction of Transmission Main for Potable Water from Lozovo Reservoir to the Mirage Hotel, consisting:
A. Twin 900 mm transmission main diameter ductile iron, 4,241 m;
B. Single 1200 mm transmission main ductile iron, 1,451 m;
C. Single 1100 mm transmission main ductile iron, 649 m;
D. Single 1000 mm transmission main ductile iron, 563 m;
E. Single 700 mm transmission main ductile iron, 905 m;
F. Valves, chambers etc. and interconnection to existing distribution system.
The contract conditions are governed by FIDIC, Conditions of Contract for Construction for Building and Engineering Works designed by the Employer (“Red Book”, First Edition 1999) with respect to the particulars of Bulgarian Law of the Spatial Planning and supplementary Ordinances.

8. Eligibility and rules of origin
Prequalification and tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms and joint ventures of firms from any country.
9. Grounds for exclusion
As per EBRD procurement rules. Further applicants must submit a signed declaration, to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contract procedures for EC external actions (see http://ec.europa.eu/comm/europeaid/tender/practical_guide_2006/index_en.htm).
10. Number of applications
Applicants may submit only one set of prequalification documents.
11. Tender guarantee
Short-listed applicants must provide a tender guarantee of 200,000 Euro when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) in accordance with the tender documents.
12. Performance guarantee
The successful tenderer will be asked to provide a performance guarantee of 10% of the Accepted Contract Amount in Euro. This guarantee must be provided within twenty-eight (28) days of receipt of the Letter of Acceptance from the Employer... If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the second best admissible tender.
13. Information meeting and site visit
Short-listed applicants will be invited for attending an information meeting and site visit.
14. Tender validity
The period of tender validity is 120 days.
15. Period of implementation
The estimated time for the completion of works is 12 months, plus 12 months for the Defects Notification Period. The works are estimated to start in the beginning of 2007.

After prequalification and submission of short-listed tenders, the global tender price.
18. How to obtain the prequalification documents
Prequalification documents may be obtained from the address below upon payment of a non-refundable fee of EUR 275 (including VAT) or equivalent in BG Leva, by bank transfer to the Vodosnabdyavane i Kanalizatsiya EAD’s accounts with:

or by post, using a certified banker’s draft drawn on any recognized international Bank, and made payable to the Vodosnabdyavane i Kanalizatsiya – EAD (City of Bourgas). The firms have to take into consideration that the banks (both those of the tenderers’ countries and the Bulgarian Banks) levy some commission, deductible from the transferred amounts, and these fees are not in Bourgas Regional Water Company charge. If requested, the documents will be promptly dispatched by courier, but the Bourgas Regional Water Company accepts no liability for loss or late delivery.
19. Deadline for submission of prequalification documents
The prequalification documents must be duly completed and delivered to the address below, on or before 12:00 p.m (noon) on 01 February 2007. Documents which are received late may be rejected and returned unopened.

Council regulation (EC) No. 1267/1999 of 21 June 1999 establishing an Instrument for Structural Policies for Pre-Accession amended by the Council regulations (EC) No. 2382/2001, 2500/2001, 769/2004, 2257/2004 and as modified by Council Regulation (EC) No. 2112/2005 of 21 November 2005 on access to Community external assistance and the agreement between the European Community, represented by the Commission of the European Community and the European Bank for Reconstruction and Development signed on 8 May 2006.
